FYFER, LLC (“Company,” “we,” “us,” or “our”) takes the privacy of our mobile device application users’ personal information seriously, and we are committed to protecting your personally identifiable information. This Privacy Policy covers how the Company addresses and safeguards personally identifiable information that is collected and received on the Company’s mobile device application (“FYFER App”) operated by the Company.

Please be aware that the Company may update this Privacy Policy. If we do, we will notify FYFER App users about significant changes by placing a prominent notice on the initial page of this Privacy Policy. Your continued use of the (“FYFER App”) following the posting of changes means that you accept and agree to the changes.

1. WHAT THIS PRIVACY POLICY COVERS

1.1. The Company collects some information about FYFER APP users to help us improve the FYFER App, and improve our products and services. As discussed below, the type of information we collect, and our use of that information, will vary depending upon the user’s level of interaction with the FYFER App.

1.2. This Privacy Policy does not cover how the Company treats personally identifiable information that it obtains from other sources, such as offline sources or through email communications. This Privacy Policy also does not apply to the practices of companies that the Company does not own or control, or to people or entities that the Company does not employ or manage.

2. WHAT INFORMATION IS COLLECTED AND HOW IT IS USED

2.1 The information we may collect via the FYFER App depends on the content and materials you use, and includes:

  • Personal Data. Demographic and other personally identifiable information (such as your name and email address) that you voluntarily give us when choosing to participate in various activities related to the FYFER App, such as User Contributions (as defined in our Terms of Use), chat, posting messages in comment sections or in our forums, liking posts, sending feedback, and responding to surveys. If you choose to share data about yourself via your profile, online chat, or other interactive areas of the FYFER App, please be advised that all data you disclose in these areas is public and will be accessible to anyone who accesses the FYFER App.
  • Derivative Data. Information our servers automatically collect when you access the FYFER App, including but not limited to your native actions that are integral to the FYFER App, including liking, re-blogging, or replying to a post, as well as other interactions with the FYFER App and other users via server log files.

2.2. Use of Personal Information. The Company collects personal information from its users, (such as their name, address, phone number, email address, etc.) only when the user voluntarily provides it to us. We may then use this information to communicate with the user regarding our products, services and promotions, solicit feedback via surveys, or provide users with information that they specifically requested. We will not send users unsolicited emails unless they have opted in for marketing communication or we are contacting a user to follow-up on a specific request, issue, or communication the user has initiated with us.

2.4. Sharing and Disclosing User Information. The Company is not in the business of selling personal information users provide on the FYFER App to other people or companies unaffiliated with FYFER, LLC. The Company does share user information to provide products or services users have requested, when we have that user’s permission, and under the following circumstances:

  • Trusted Partners. We provide information to trusted partners who work on our behalf or with the Company under confidentiality agreements. These companies may utilize users’ personal information to help the Company communicate with those users about us. Examples of such instances include receiving a user’s Customer Relations question or comment, sending and capturing survey questions and data or receiving an employment applicant’s resume, application or other job related information or attachment. However, these companies do not have any independent right to share this information.
  • Legal Matters. We may share a user’s information to respond to subpoenas, court orders, or legal processes, or to otherwise cooperate with law enforcement agencies or officials, or to establish or exercise our legal rights or defend against legal claims.
  • Investigations into Illegality. We may share user information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to physical safety of any person, violations of the Company’s Terms of Use, or as otherwise required by law.
  • Mergers. We may transfer information about a user if the Company is acquired by or merged with another company.

3. LINKS TO THIRD PARTY WEBSITES

The FYFER App may contain links to websites owned and operated by third parties. Any links to the websites of third parties are provided solely for your convenience or by other users of the FYFER App, and such websites are not owned or operated by the Company. The Company has no control over the privacy practices of third party websites, and user activities at those website will be governed by the policies and practices of those third parties. We assume no responsibility for the information practices of such other websites. We encourage users to review the privacy practices of these third parties before disclosing any personally identifiable information, as the Company is not responsible for the privacy practices or website content of those websites.

When you click on links in the FYFER App that take you to third-party websites, you will be subject to the third parties’ privacy policies. While we support the protection of privacy on the Internet, we cannot be responsible for the actions of any third-party websites. We encourage you to read the posted privacy policies of any and every website you visit, whether you are linking from the FYFER App or browsing on your own.

4. CONFIDENTIALITY AND SECURITY

The Company uses industry standard methods and takes commercially reasonable precautions to prevent unauthorized access or disclosure to your personally identifiable information, to maintain data and information accuracy, and to facilitate the appropriate use of information. Specifically, the Company has implemented a variety of encryption and security measures to protect information stored in our computer systems from unauthorized access; we utilize electronic, and managerial procedures to protect users’ personally identifiable information that we collect online; and we maintain procedural safeguards restricting access to personally identifiable information only to employees (or our agents under confidentiality agreements) who need to know such information in order to provide the products and services that users request.

Unfortunately, data transmission over public networks cannot be guaranteed to be one hundred percent secure.  As such, although the Company takes appropriate measures to safeguard against unauthorized disclosures of information, we cannot guarantee that users’ personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with this Privacy Policy, and you use the FYFER App at your own risk.  If you suspect your Personal Information has been compromised, please notify the Company’s Customer Service using the following contact information: contact@fyferapp.com.

5. CHILDREN

The FYFER App is intended for adult users and the Company does not knowingly collect personal information from anyone who has not reached the age of majority in the state or country in which he or she resides, nor does the Company intentionally allow anyone who has not reached the age of majority in the state in which he or she resides to register as a member or submit content for publication on this the FYFER App. Thus, the Company strongly encourages parents to play an active role in their child’s online activity. 6. USER’S ACCEPTANCE OF PRIVACY POLICY TERMS

By using the FYFER App, you acknowledge your consent to and understanding of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, do not use the FYFER App. Your continued use of the FYFER App following the posting of changes to this Privacy Policy will mean that you accept those changes.

8. CALIFORNIA-SPECIFIC PRIVACY RIGHTS

California Civil Code Section § 1798.83 permits users of the FYFER App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
